The short version

  • These terms apply when you use Wattle Cloud. If you're a consumer, you keep every right that consumer law gives you.
  • You own what you deploy. You're responsible for it, and it must follow our Acceptable Use Policy.
  • Plans are one price a month that covers everything they include, with no usage charges. They renew monthly until you cancel.
  • You can cancel at any time. After your account closes, you have 30 days to get your data out before we delete it.
  • We give you at least 30 days' notice of changes that could disadvantage you, and you can leave before they apply.

This summary is here to help you find your way. The full text below is what applies.

1.About these terms

These Terms of Service (“terms”) are an agreement between you and WattleCloud Pty Ltd (ABN 97 703 308 605), trading as Wattle Cloud (“Wattle Cloud”, “we”, “us” or “our”).

They apply when you visit our website, open an account or use any of our services. By opening an account or using the services, you agree to them. Our services include hosting for websites, apps and Discord bots, managed databases, game servers, the dashboard, the game panel, the wattle command line tool, our public API and MCP server, and support (together, the “services”).

Our Acceptable Use Policy, Refund Policy, Service Levels and Data Processing Agreement form part of these terms. Our Privacy Policy and Cookie Policy explain how we handle personal information.

If you use the services for an organisation, such as your employer or your business, you confirm that you're allowed to accept these terms for it. In that case, “you” means the organisation.

Some features may be labelled early access or beta. They may change, have limits or stop, and we'll tell you if extra terms apply to them.

2.Your account

  • You must be at least 18 years old to open an account.
  • Give us accurate details and keep them up to date, especially your email address. It's where we send alerts, receipts and notices.
  • Keep your sign-in details secure, and turn on two-factor authentication or use a passkey. If you think someone has got into your account, tell us straight away at support@wattlecloud.com.
  • You're responsible for what happens in your account and workspaces, including what the people you invite do. Give people only the access they need.
  • Don't open extra accounts to avoid a suspension or get around your plan's limits.

We may decline to open an account, for example to prevent fraud or abuse, or where the law doesn't allow us to provide the services.

3.Plans and payment

Our current plans and game server plans are on our pricing page. Prices are in Australian dollars for the Brisbane region and British pounds for the UK and Europe regions.

Monthly plans

Hobby and Pro are monthly plans. A plan renews each month until you cancel it, and we charge its price at the start of each billing period.

Each plan includes set amounts of CPU, memory, storage and outbound traffic, shown on the pricing page. The plan's price covers all of it: we don't charge for usage. If your workloads need more than your plan includes, you can move to a bigger plan or contact us.

Free trial

A new workspace can try Hobby free for 7 days. We ask for a card when the trial starts and don't charge it during the trial. There's one free trial per workspace and per card: if your card has had one before, your paid plan starts straight away.

When the trial ends, it carries on as a paid Hobby plan and we charge its price, unless you cancelled before then. We'll email you the day before it ends. You can cancel at any time during the trial in your dashboard.

If the trial ends without a paid plan, your services stop when it ends. We keep their data for 7 days in case you choose a plan, and then delete it.

During the trial some features are limited, such as custom domains. Our docs list what's limited.

Game servers

Game servers have their own fixed monthly plans, shown on the pricing page once they're available. We charge for them at the start of each billing period, and they renew monthly until you cancel.

Paying

You authorise us to charge your payment method for amounts you owe under these terms. We send a receipt for each payment. Where GST, VAT or a similar tax applies, your invoice shows it. Your bank may charge its own fees, for example for paying in a foreign currency.

If a payment fails, we'll email you and try again. If an amount is still unpaid 7 days after our first email, we may suspend your services until it's paid. If it's still unpaid 30 days after that, we may close your account as described in Cancelling and closing your account. We'll email you before we delete anything.

If you think we've charged you wrongly, tell us at support@wattlecloud.com and we'll look into it. Please talk to us before you ask your bank to reverse a payment.

Price changes

We may change our prices. We'll email you at least 30 days before a new price applies to you, and you can cancel before then. A price change never applies to a billing period you've already paid for.

4.Cancelling and closing your account

If you cancel

You can cancel a plan at any time in the dashboard. To close your account, email support@wattlecloud.com from your account's email address. When you cancel a plan, it stays active until the end of the billing period you've paid for. Our Refund Policy explains when you can get money back.

If we suspend or close your account

We may suspend services or close your account if:

  • you seriously or repeatedly break these terms or the Acceptable Use Policy
  • you don't pay, as described in Plans and payment
  • we need to, to follow the law, a court order or a direction from a regulator
  • it's needed to protect the services, our other customers or the public, for example from an attack, malware or illegal content

Where we can, we'll tell you first, explain why and give you a reasonable chance to fix the problem. We act straight away when there's a risk of serious harm or the law requires it. If we suspend something by mistake, we'll restore it as soon as we can.

If we stop offering a service

We may stop offering a service, feature or region. If that affects you, we'll give you at least 60 days' notice, help you move your data, and refund anything you've paid for the time after it stops.

Your data after your account closes

After your account closes, we keep your data for 30 days so you can export it, and we'll help you get it out if you ask. Then we delete it, unless you ask us to delete it sooner or the law requires us to keep it. Copies in backups are deleted as those backups expire. We keep some records for longer where the law requires, as our Privacy Policy explains.

Parts of these terms that by their nature should continue after your account closes, such as paying amounts owed, liability and disputes, continue to apply.

5.Your content

You own what you deploy, store or upload with us, such as code, websites, files, databases and game worlds (“your content”). These terms don't give us ownership of any of it.

You give us permission to host, copy, process, back up and transmit your content, only as needed to provide the services to you, keep them secure and follow the law. This permission ends when your content is deleted from our systems.

We don't look at your content except where we need to in order to provide the services, where you ask us to (for example in a support request), to investigate abuse or a breach of these terms, or where the law requires it.

You're responsible for your content: that you have the right to use it, that it's lawful and follows the Acceptable Use Policy, and that you handle any personal information in it lawfully.

We take care of your data and back up databases as described for your plan. Even so, keep your own copies of anything important. You can export a database at any time.

A delete made in the dashboard happens straight away. A delete made with an API token, the command line tool or an AI agent waits 48 hours, so you can undo it.

6.Using the services

Use the services only as these terms and the Acceptable Use Policy allow. You must follow the laws that apply to you and your content, including Australian laws about online content: the Online Safety Act 2021 and the industry codes and standards registered under it.

If you connect a tool or an AI agent to your account, for example through an API token or our MCP server, what it does with that access is done on your behalf, and you're responsible for it.

Your workloads may include third-party software, such as databases, frameworks, Docker images, templates, game server software, mods and plugins. That software comes with its own licence terms, and you must follow them. For example, a Minecraft server must follow the Minecraft EULA, and a Discord bot must follow Discord's developer terms.

You can host projects for your clients as part of your own work, and you're responsible for making sure they follow these terms too. To resell the services as a hosting product of your own, you need our written agreement.

If a workload puts the platform or other customers at risk, for example by overloading shared hardware, we may limit or stop it. We'll tell you what happened and why.

7.Our services and support

We provide the services with due care and skill.

We work to keep the services running, but we can't promise they'll always be available or free of errors. Our Service Levels set out the availability we aim for and what we do when something goes wrong. At launch they're targets, without service credits.

We sometimes need to carry out maintenance. We aim to avoid downtime, and we give advance notice of planned work that's likely to affect your workloads, as our Service Levels describe.

We keep improving the services and may change how they work. We won't make a change that significantly reduces what you've paid for during a billing period. If a change significantly affects you, we'll give you notice as described in Changes to these terms.

Support is by email at support@wattlecloud.com, answered by a person. Pro workspaces get priority support. Our Service Levels list our support hours and how quickly we aim to reply.

8.Security

We protect the services with technical and organisational measures that suit the risk. Our Security page describes how customers are kept apart.

Security is shared. We look after the platform. You look after what you build and how you set it up: your code, its dependencies, your secrets, your users' accounts and the access you give people.

If we become aware of a security incident that affects your account or your content, we'll tell you without undue delay and share what you need to meet your own obligations.

Found a security problem in our services? Email support@wattlecloud.com. Our Acceptable Use Policy explains how to test responsibly.

9.When we process personal information for you

Your content may include personal information, such as details of your app's users or your game server's players. You decide why and how that information is processed, and we process it on your behalf. Under the UK GDPR and the EU GDPR, you're the controller and we're your processor.

Our Data Processing Agreement forms part of these terms and applies whenever we process personal information in your content. It sets out how we protect it, the service providers we use, how we tell you about a breach, and the safeguards for transfers out of the UK and EEA.

You're responsible for having a lawful basis to process the personal information in your content, and for giving people any notices the law requires.

10.Intellectual property and trademarks

We own the services, including our software, website, documentation and brand. These terms give you the right to use the services as they allow, and nothing more.

While your account is open, you may use the wattle command line tool, the public API and the MCP server with your account. If we publish any of our software under an open-source licence, that licence applies to it instead.

If you send us feedback or ideas, we can use them without owing you anything.

Trademarks

Product and game names on our website, such as PostgreSQL, MySQL, MariaDB, Valkey, ClickHouse, Minecraft, Garry's Mod, Rust and Discord, belong to their owners. We use them only to describe what you can run on Wattle Cloud.

PostgreSQL, MySQL, MariaDB, Redis and ClickHouse are trademarks of their respective owners.

Minecraft, Garry's Mod and Rust are trademarks of their respective owners. Wattle Cloud is not affiliated with or endorsed by their publishers.

Not an official Minecraft product. Not approved by or associated with Mojang or Microsoft.

11.Your rights under consumer law

Nothing in these terms excludes, restricts or changes a right or remedy you have under a law that can't be excluded, including the Australian Consumer Law and the UK Consumer Rights Act 2015.

Australia

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

United Kingdom

If you're a consumer in the UK, the law requires us to provide the services with reasonable care and skill, and as we've described them. If we don't, you can ask us to put things right or, if we can't, get some or all of your money back. You can also cancel within 14 days of your first payment, as our Refund Policy explains. For advice about your rights, contact Citizens Advice.

12.Our liability

This section limits our liability. It doesn't limit anything the law doesn't allow us to limit, such as liability for death or personal injury caused by negligence, for fraud, or under the consumer guarantees in the Australian Consumer Law except as allowed below.

If you're a consumer

If you use the services for personal, domestic or household purposes, we're responsible for loss or damage you suffer that's a foreseeable result of our breaking these terms or failing to use due care and skill. Loss is foreseeable if it's obvious it will happen, or if we both knew it might happen when you started using the services. We're not responsible for loss that isn't foreseeable, or for business losses.

If you use the services for business

  • If the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, where the law allows, to supplying the services again or paying the cost of having them supplied again.
  • We're not liable for indirect or consequential loss, or for lost profits, revenue, business opportunities or goodwill.
  • Our total liability to you for all claims in any 12-month period is limited to the amounts you paid us for the services in the 12 months before the event that gave rise to the claim.
  • The same limits apply to your liability to us, except for amounts you owe us, claims described in Claims caused by your content, and breaches of the Acceptable Use Policy.

Events outside anyone's control

Neither of us is responsible for a delay or failure caused by events outside our reasonable control, such as natural disasters, widespread internet or power outages, or actions of governments, as long as we take reasonable steps to limit the effect. This doesn't affect your rights under consumer law.

13.Claims caused by your content

This section applies if you use the services for business. If someone makes a claim against us because of your content, or because you or people using your account broke the Acceptable Use Policy, you'll cover our reasonable costs and losses from that claim, except to the extent we caused or contributed to them. We'll tell you about the claim promptly, let you take part in dealing with it, and won't settle it without talking to you first.

14.Changes to these terms

We may update these terms, for example when we add services or the law changes.

If a change could disadvantage you, we'll email you at least 30 days before it takes effect. If you don't agree with it, you can close your account before then, and we'll refund anything you've prepaid for the time after the change.

Other changes take effect when we publish them, such as clarifications, changes that benefit you, and changes needed to deal with new kinds of abuse or security threats. Changes the law requires us to make sooner take effect when the law requires, and we'll tell you about them.

The date at the top of this page shows when these terms last changed. Earlier versions are available on request.

15.Complaints and disputes

If something isn't right, email support@wattlecloud.com and tell us what happened. A person will look into it and reply.

If we can't sort it out together, you can contact a consumer protection agency: in Australia, the fair trading office in your state or territory or the ACCC; in the UK, Citizens Advice.

These terms are governed by the law of Queensland, Australia, and the courts of Queensland can hear disputes about them. If you're a consumer who lives in the UK, you also keep the protection of the mandatory laws of the country where you live, and you can bring proceedings in your local courts.

16.General

  • These terms, with the policies they refer to, are the whole agreement between you and us about the services.
  • If a court decides part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a right straight away, we can still enforce it later.
  • You can't transfer your account or these terms to someone else without our written agreement. We may transfer these terms, your account and our rights and obligations under them to a company we set up to run Wattle Cloud, such as a proprietary limited company we control, or to a business that takes over the services. You agree to that transfer now. We'll tell you before it happens, and a transfer won't reduce your rights.
  • We send notices to the email address on your account. You can send notices to us at support@wattlecloud.com.
  • You can't use the services if you're the subject of sanctions under Australian, UK or other applicable law, or in a way that breaks sanctions or export laws.
  • Nothing in these terms gives rights to anyone except you and us.
